Terms and Conditions

1. Introduction

1.1. These Terms and Conditions govern the "Prize Draw") run by Ice Travel Group and B&M Retail Limited (together, "the Promoters"). By entering the Prize Draw, participants agree to be bound by these Terms and Conditions.

1.2. The Prize Draw is open to residents of the United Kingdom (England, Wales, Scotland and Northern Ireland – excluding Ireland), the Channel Islands or the Isle of Man aged 18 years or over only.

1.3 The Prize Draw will have one Winner of the main Prize and also 5 Runners Up.

2. How to Enter

2.1. To enter the Prize Draw, participants must submit their email address via the entry form on the IceLolly.com website by 31/03/2025. Only one entry per person is allowed.

2.2. No purchase is necessary to enter the Prize Draw.

2.3 The Promoter reserves the right to refuse any entry, or to award any prize to anyone that is believed to be in breach of these Terms and Conditions.

2.4 Employees of Ice Travel Group and B&M Retail Limited are ineligible from entering the Prize Draw.

2.5 The winner (subject to eligibility) will be selected at random by using a randomiser tool. Should the winner not meet the Eligibility Criteria then their winner status and entitlement will become void and another winner will be chosen. The decision of the Promoter as to the winner will be final and no correspondence will be entered into.

3. Prize

3.1. The Main Prize consists of a £50 spending voucher redeemable at B&M Retail and a holiday package to Benidorm (the "Prize"). There will be 5 x runners up, who will each receive a Runners Up Prize of B&M Shopping Voucher worth £30 each.

3.1.2 The Main Prize:

-4 night stay for a family (maximum 4 pax, 2 adults and 2 children) at a 4* Hotel in Benidorm (Bed & Breakfast board basis)

-Flights to Benidorm are covered by Ice Travel Group to the value of £500 in total and are subject to availability including baggage allowance. Please note transfers are NOT included.

-To be used within a year since the winner announcement

The Prize must be redeemed before 31st December 2025.

The Prize may not be taken between the following dates:

Easter holiday: Monday 7 April to Monday 21 April 2025. Half-term holiday: Monday 26 May to Friday 30 May 2025 Summer holiday: 22 July 2025 to Monday 01 September 2025 Christmas and New Year holiday: Monday 22 December 2025 to Friday 2 January 2026.

3.2. The Prize is non-transferable, non-exchangeable, and no cash alternative will be offered.

3.3. The Promoters reserve the right to substitute the Prize with another of equivalent value without giving notice.

3.4 All Prizes are subject to availability and the Promoter reserves the right to replace any of the prizes with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so.

3.5 All Prizes are non-exchangeable, non-transferable and have no cash value. No cash equivalent will be given

4. Winner Selection

4.1. The winner will be selected at random from all valid entries received before the closing date.

4.2. The winner will be notified by email within 10 days of the closing date. The winner must respond within 5 days to claim the Prize. Failure to respond within this time frame may result in the Prize being forfeited, and the Promoters reserve the right to select an alternative winner.

4.3 The five Runners Up will be selected at random from all valid entries received before the closing date.

4.4 The Runners Up will be notified by email within 10 days of the closing date. The Runners Up must respond within 5 days to claim the Prize. Failure to respond within this timeframe may result in the Prizes being forfeited, and the Promoters reserve the right to select an alternative winner.

4.5 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails marketing@bmstores.co.uk or writes to B&M Retail Limited, The Vault, Dakota Drive, Estuary Commerce Park, Speke, Liverpool, L24 8RJ (enclosing a self-addressed envelope) within one month after the closing date stated in condition 4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter marketing@bmstores.co.uk or marketing@icetravelgroup.com B&M Retail Limited, The Vault, Dakota Drive, Estuary Commerce Park, Speke, Liverpool, L24 8RJ or Ice Travel Group Limited Park Row House, 19-20 Park Row, Leeds, West Yorkshire, United Kingdom, LS1 5JF. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

5. Data Protection

5.1. By entering the Prize Draw, participants consent to the processing of their personal data by the Promoters for the purpose of administering the Prize Draw in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

5.2. The personal data provided will be used solely for the purposes of the Prize Draw and will not be shared with third parties without the participant’s consent, except where required by law.

5.3. Participants have the right to access, rectify, or erase their personal data and to restrict or object to its processing by contacting compliance@icelolly.com

5.4 All Prize Draw entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned

5.5. Data and Privacy

(i) By participating in this Prize Draw, you agree to the use of your personal data as described in these Terms and Conditions, and in particular in this paragraph 7.

(ii) Our Privacy Policy explains how we use your data

(iii) We are not responsible or liable for any loss or damage you may suffer or incur in connection with the privacy policy applying to any third-party website or for any acts, omissions, errors or defaults of any third party in connection with that privacy policy.

6. Liability

6.1. The Promoters will not be liable for any loss, damage, or injury arising from or in connection with the Prize Draw or the Prize, except for any liability which cannot be excluded by law.

6.2. The Promoters are not responsible for any issues related to the Prize, including but not limited to the quality or availability of the holiday package or any services related to the holiday.

6.3. The winner agrees to release the Promoters from any liability related to the use or enjoyment of the Prize, including any personal injury or property damage incurred during the

6.4 The Winner and their travelling party are responsible for ensuring they hold a valid passport and any necessary visa to travel, hold all adequate travel insurance policies, and comply with any other Terms and Conditions applicable to the Prize.

6.5 The Promoter is not liable for any costs incurred by winners in the redemption of any of the Prizes.

6.6 It is the responsibility of The Winner and all members of the travelling party to check and ensure they have a valid passport at the time of redeeming The Prize.

7. General

7.1 We reserve the right to withhold or withdraw the Prize if, in our sole discretion, it appears that a person claiming it does not fully meet the Eligibility Criteria, if a Purchase is cancelled or invalidated prior to the Closing Date, or we deem the Purchase to have been made fraudulently, invalidly or using automated means. We reserve the right to require reasonable proof of identity and eligibility from any person claiming a Prize.

7.2 Any additional costs which may be incurred by this Prize Draw in the context of participation, such as internet costs and other additional services are not included in the Prize Draw and must be paid by you separately.

7.3 No alternative reward will be provided in whole or in part for the Prize, except that in the event of circumstances outside of our control we reserve the right to substitute similar rewards of equal value. The Prize is subject to promotional availability and is not transferable.

7.4 To the fullest extent permitted by law, we do not accept any responsibility or liability under or in connection with this Prize Draw and/or these Terms and Conditions (including without limitation as a result of technical fault, computer or electronic malfunction, or incomplete, illegible, late, lost or fraudulent entries). Any statutory rights you have are not affected.

7.5 Insofar as permitted by law, we will not be responsible or liable to compensate you, or accept any liability, for any personal loss, expense or damage in connection with this Prize Draw or accepting or using the Prize except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. Your statutory rights are unaffected.

7.6 We reserve the right, at our sole discretion, to cancel, modify this Prize Draw and/or these Terms and Conditions, at any time before you have accepted it/them, including but not limited to terminating or withdrawing the Prize at any time.

7.7 If any paragraph in these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other paragraphs of these Terms and Conditions, which shall remain in full force and effect.

7.8 These Terms and Conditions shall be governed by and construed in accordance with the laws of England. The Courts of England and Wales shall have exclusive jurisdiction in connection with these Terms and Conditions.

Opt-In Terms and Conditions

1. Introduction

1.1. By entering the "Prize Draw", you agree to opt-in to receive marketing communications from both Ice Travel Group Ltd and B&M Retail LTD (together, "the Promoters").

1.2. You may receive newsletters, promotional offers, and other marketing materials via email from both Promoters.

2. Consent to Marketing Communications

2.1. By providing your email address and entering the Prize Draw, you consent to the Promoters using your email address to send you marketing communications in accordance with these Terms and Conditions.

2.2. You confirm that you are the owner of the email address provided and that you have the authority to grant this consent.

3. Unsubscribing

3.1. You may unsubscribe from marketing communications from either Promoter at any time by clicking the "unsubscribe" link in any email received or by contacting the Promoter directly at marketing@bmstores.co.uk or marketing@icetravelgroup.com.

3.2. Unsubscribing from one Promoter's marketing communications will not automatically unsubscribe you from the other Promoter's communications. You must unsubscribe separately from each Promoter’s emails if you wish to stop receiving communications from both.

4. Data Protection

4.1. The Promoters will process your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

4.2. Your personal data will be used solely for the purposes of sending you marketing communications and will not be shared with third parties without your consent, except where required by law.

4.3. You have the right to access, rectify, or erase your personal data and to restrict or object to its processing by contacting the relevant Promoter at [Company A’s data protection officer/contact details] or [Company B’s data protection officer/contact details].

5. Withdrawal of Consent

5.1. You have the right to withdraw your consent to receive marketing communications at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

6. Changes to Terms and Conditions

6.1. The Promoters reserve the right to amend these Opt-In Terms and Conditions at any time. Any changes will be communicated to you via email or published on the Promoters' websites.
